This document is an electronic record under the Information Technology Act of 2000 and any applicable rules, as well as the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act of 2000. A computer system generates this electronic record, which does not require any physical or digital signatures.

This document is published in accordance with Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which require the publication of the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name www.bymin.com and its "Website," including the related mobile site and mobile application (hereinafter referred to as "Platform").

Your use of the Platform and its services and tools is governed by the following terms and conditions as they apply to the Platform, including the applicable policies, which are incorporated herein by reference. If You transact on the Platform, You will be subject to the Platform's policies for such transaction. By simply using the Platform, You are contracting with Bymin Private Limited, and these terms and conditions, including the policies, constitute Your binding obligations to Bymin.

For the purposes of these Terms and Conditions, "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Platform by providing Registration Data while registering as a Registered User on the Platform using computer systems. Bymin allows the User to browse the Platform and make purchases without registering. Bymin Private Limited is referred to as "We," "Us," and "Our."

When You use any of the services provided by Us through the Platform, including but not limited to (e.g. Product Reviews, Seller Reviews), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, which shall be deemed to be incorporated into and considered part and parcel of this Terms of Use.

We reserve the right, at Our sole discretion, to change, modify, add, or remove portions of these Terms of Use at any time without providing You with prior written notice. It is Your responsibility to review these Terms and Conditions for updates and changes on a regular basis.

Your continued use of the Platform after the changes are posted indicates that You accept and agree to the revisions. We grant You a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform as long as You comply with these Terms and Conditions.

ACCESSING, BROWSING, OR OTHERWISE USING THE SITE CONSTITUTES YOUR AGREEMENT TO ALL OF THE TERMS OF USE SET FORTH IN THESE TERMS AND CONDITIONS, SO PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING.

You accept and agree to be bound by Bymin Policies (including but not limited to Privacy Policy available at Privacy) as amended from time to time by implicitly or expressly accepting these Terms of Use.

Transactions on the Platform are only available to those who can form legally binding contracts under the Indian Contract Act of 1872. Persons who are "incompetent to contract" under the Indian Contract Act of 1872, such as un-discharged insolvents, are not eligible to use the Platform.

If you are a minor, that is, under the age of 18, you may only use the Platform or access content on the Platform with the supervision and prior consent/permission of a parent or legal guardian.

If you are a minor and wish to transact on the Platform, your legal guardian or parents may do so. Bymin reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if it is brought to our attention or it is discovered that You are under the age of 18 and transacting on the Platform.

If You use the Platform, You are responsible for keeping your Display Name and Password confidential, and You are responsible for all activities that occur under your Display Name and Password.

You agree that if You provide any information that is false, inaccurate, out of date, or incomplete, or if We have reasonable grounds to suspect that such information is false, inaccurate, out of date, or incomplete, or not in accordance with these Terms and Conditions, We shall have the right to indefinitely suspend, terminate, or block access to your membership on the Platform and refuse to provide You with access to the Platform.

On the Platform, Your primary identifier is Your mobile phone number and/or e-mail address. It is your responsibility to keep your mobile phone number and email address on the Platform up to date at all times. You agree to promptly notify Us if your mobile phone number or e-mail address changes by updating the information on the Platform using a one-time password verification.

If You share or allow others to access Your account on the Platform ("Account"), whether by creating separate profiles under Your Account or otherwise, they will be able to view and access Your Account information. You will be solely liable and responsible for all activities carried out under Your Account, as well as any consequences thereof.

When You use the Platform to send emails or other data, information, or communication to us, You agree and understand that You are communicating with Us via electronic records, and You consent to receive communications from Us via electronic records on a regular and as-needed basis. We may communicate with you via email or other electronic or non-electronic means.

The Platform is a venue for Users to meet and interact with one another in order to conduct business. Bymin is not and will not be a party to or control any transaction involving Platform Users.

• All commercial/contractual terms are offered and agreed to solely by Buyers and Sellers. Commercial/contractual terms include, but are not limited to, price, shipping costs, payment methods, payment terms, date, period, and mode of delivery, warranties related to products and services, and after sales services related to products and services. Bymin has no influence, does not determine or advise, and is not involved in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers. All discounts and offers (including exchange offers) are made by the Seller/Brand, not by Bymin.
• The placement of an order on the Platform by a Buyer with Seller is an offer to buy the product(s) in the order by the Buyer to the Seller and shall not be construed as Seller's acceptance of Buyer's offer to buy the product(s) ordered. The Seller reserves the right, at its sole discretion, to cancel any such order placed by the Buyer, and the Buyer will be notified of this via email/SMS. Any transaction price paid by Buyer in the event of Seller's cancellation will be refunded to the Buyer. Furthermore, if the quantities exceed the average individual consumption, the Seller may cancel the order.
• Bymin makes no representation or warranty regarding the specifics (such as quality, value, salability, and so on) of the products or services proposed to be sold, offered to be sold, or purchased on the Platform. Bymin does not support or endorse the sale or purchase of any products or services on the Platform, either implicitly or explicitly. Bymin accepts no responsibility for any errors or omissions, whether on its own or on behalf of third parties.
• Bymin is not liable for any breach or non-performance of any contract entered into between Buyers and Sellers. Bymin cannot and does not guarantee that any transaction concluded on the Platform will be carried out by the relevant Buyers and/or Sellers. Bymin is not required or authorized to mediate or resolve any dispute or disagreement between Buyers and Sellers.
• Bymin makes no representation or warranty regarding any of its Users' item-specifics (such as legal title, creditworthiness, identity, and so on). You should independently verify the legitimacy of any particular User with whom You choose to deal on the Platform and use Your best judgment in that regard.
• Bymin shall have no right, title, or interest in the products at any time, nor shall Bymin have any obligations or liabilities in relation to any contract entered into between Buyers and Sellers. Bymin is not liable for unsatisfactory or delayed service performance, or for damages or delays caused by products that are out of stock, unavailable, or back ordered.
• The Platform is simply a platform that Users can use to reach a larger audience to buy and sell products or services. Bymin is only providing a communication platform, and it is agreed that any contract for the sale of any of the products or services will be strictly bipartite between the Seller and the Buyer.
• You may be eligible for GST input tax credit if You purchase product(s) eligible for business purchases. As a result, the Seller(s) selling such products will issue you an invoice containing the GSTIN that you provided ("Tax Invoice").
• GST invoices will include the following information, among other things: -GSTIN associated with your registered business, as provided by you.
• Not all products are eligible for business purchases on the Platform, and this is entirely at the Sellers' discretion. The eligibility of Tax Invoice will be displayed on the Platform's product page.
• Purchases made on the Platform must be for personal consumption only. Users are not permitted to use products purchased on the Platform for commercial, promotional, resale, or further distribution.
• Please specify the delivery address as the address listed as the registered place of business on the GST authority's records in order to receive input tax credit as quickly as possible. Please keep in mind that taking advantage of input tax credit is subject to the provisions of the GST Act and rules.
• The delivery and billing addresses must be the same; please keep in mind that the GST authority will deny input tax credit if the delivery address and GSTIN on the GST invoice are from different states.
• If You do not provide your GSTIN and/or business entity details, it will be assumed that you are making a personal purchase rather than a business purchase.
• Bymin is not responsible for verifying the accuracy of the GSTIN and/or entity name provided by You, and You are solely responsible for providing accurate information.
• Bymin and Seller will not consider any requests for revisions to the GST Invoice. Bymin and Seller will not be held liable for Your failure to comply, including for reasons related to information provided by You.
• Bymin will not be liable if You are unable to obtain input tax credit or if You are denied input tax credit for any reason.
• You will be solely responsible for all compliances required by applicable laws.
• You agree to indemnify and hold Bymin and Seller harmless from all losses, claims, costs, expenses, suits, proceedings, or any other liability arising out of or in connection with (1) the GSTIN and/or entity name provided by you or the input tax credit claimed by you or your use or misuse of the GST Invoice and (2) your non-compliance with the applicable laws or (3) your use or misuse of the GST Invoice.
• If fraudulent activity is detected, Bymin reserves the right to deny You access to the Platform.
• If any fraudulent activity is discovered, the seller reserves the right not to issue a Tax Invoice or to issue a credit note against an already issued Tax Invoice in order to cancel the transaction.
• You must independently agree on the method and terms and conditions of delivery, payment, insurance, and so on with the seller(s) with whom You transact.
• You release and indemnify Bymin and/or any of its officers and representatives from any cost, damage, liability, or other consequence of any of the Platform's Users' actions, and you expressly waive any claims that you may have in this regard under any applicable law. Despite its reasonable efforts, Bymin cannot accept responsibility for or control the information provided by other Users and made available on the Platform. Other Users' information may be offensive, harmful, inconsistent, inaccurate, or deceptive to you. When using the Platform, please exercise caution and trade safely.

Disclaimer: Pricing on any product(s) reflected on the Platform may be incorrectly reflected due to a technical issue, typographical error, or product information published by seller, and in such an event, seller may cancel such your order (s).

Bymin may levy a small fee for browsing and purchasing on the Platform. Bymin reserves the right to modify its Fee Policy at any time. In particular, Bymin reserves the right to introduce new services/fees and modify some or all of the existing services/fees offered on the Platform at its sole discretion. In such a case, Bymin reserves the right to charge for the new services offered or to amend/introduce fees for existing/new services.

Changes to the Fee Policy will be posted on the Platform, and such changes will become effective immediately after they are posted. Unless otherwise specified, all fees are in Indian rupees. You will be solely responsible for ensuring that all applicable laws, including those in India, are followed when making payments to Bymin Private Limited.

You agree, undertake, and confirm that Your use of the Platform will be governed strictly by the following binding principles:

You are not permitted to host, display, upload, modify, publish, transmit, update, or share any information that:
• belongs to someone else and to which You have no legal claim.
• (b) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invading another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any way; or unlawfully threatening or harassing, including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.
• is in any way deceptive and misleading.
• is clearly offensive to the online community, such as sexually explicit content or content that promotes obscenity, paedophilia, racism, bigotry, hatred, or any form of physical harm against any group or individual.
• harasses or advocates for the harassment of another.
• involves sending "junk mail," "chain letters," or unsolicited mass mailing or "spamming".
• encourages illegal activities or abusive, threatening, obscene, defamatory, or libellous behavior.
• infringes or violates the rights of any third party [including, but not limited to, intellectual property rights, privacy rights (including, without limitation, unauthorized disclosure of a person's name, email address, physical address, or phone number), or publicity rights].
• promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files.
• includes restricted or password-protected access pages, as well as hidden pages or images (those that are not linked to or from another accessible page.
• provides material that sexually, violently, or otherwise inappropriately exploits people, or solicits personal information from anyone.
• instructs on illegal activities such as making or purchasing illegal weapons, violating someone's privacy, or providing or creating computer viruses.
• includes video, photographs, or images of someone else (with a minor or an adult).
• tries to gain unauthorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend requests, or other areas of the Platform, or solicits passwords or personal identifying information from other users for commercial or unlawful purposes.
• without Our prior written consent, engages in commercial activities and/or sales such as contests, sweepstakes, barter, advertising, and pyramid schemes, or the buying or selling of "virtual" products related to the Platform. Throughout these Terms of Service, "Bymin's prior written consent" refers to a communication from the Bymin Legal Department that is specifically in response to Your request and addresses the activity or conduct for which You seek authorization.

• Bymin Foundation is a Section 8 company, as defined by the Companies Act of 2013.
• The amount donated will be given to NGOs and other charitable organizations working in the selected thematic areas.
• The contribution will not be refunded once it has been made.
• There will be no certificate issued under section 80G of the Income Tax Act of 1961.
• By donating, you acknowledge and confirm that this donation is not from a foreign source as defined by the Foreign Contribution (Regulation) Act of 2010.
• Bymin Foundation disclaims all liability and accepts no responsibility for any consequences resulting from the NGOs' or charitable organizations' actions or inactions.
• By proceeding with the donation, you expressly consent to and waive any and all claims, rights of action, and/or remedies (under law or otherwise) that you may have against any of the Bymin Group entities arising out of or in connection with the aforementioned transaction.
• The donation is collected on behalf of the Bymin Foundation and distributed to the Bymin Foundation. Bymin Pvt Ltd disclaims all liabilities and accepts no responsibility for the consequences of the Bymin Foundation's actions or inactions.

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, and artwork (collectively, "Content") are third party user generated content, over which Bymin has no control because Bymin is merely an intermediary for the purposes of these Terms and Conditions.

Unless expressly stated otherwise in these Terms and Conditions, no part of the Platform or Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including "mirroring") to any other computer, server, Platform, or other medium for publication or distribution, or for any commercial enterprise, without Bymin's prior written consent.

You may use information on products and services purposefully made available for downloading on the Platform, provided that You (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additions to any such information.

You are fully responsible for any notes, messages, emails, reviews, ratings, billboard postings, photos, drawings, profiles, opinions, ideas, images, videos, audio files, or other materials or information that you post or transmit to the Platform (collectively, "Content"). Such Content will become Our property, and You grant Us worldwide, perpetual, and transferable rights to it.

We shall be entitled to use the Content or any of its elements for any type of use forever, including but not limited to promotional and advertising purposes and in any media now known or hereafter devised, in accordance with Our Privacy Policy as adopted in accordance with applicable law, including the creation of derivative works that may include the Content You provide. You agree that any Content You post may be used by us in accordance with Our Privacy Policy and Site Rules of Conduct, as stated herein, and that You are not entitled to any payment or other compensation for such use.

SOME CONTENT ON THE PLATFORM MAY BE UNSUITABLE FOR SOME VIEWERS; AS A RESULT, VIEWER DISCRETION IS ADVISED. ALSO, SOME OF THE CONTENT ON THE PLATFORM MAY NOT BE APPROPRIATE FOR CHILDREN TO VIEW. PARENTS AND/OR LEGAL GUARDIANS ARE ADVISED TO EXERCISE DISCRETION BEFORE ALLOWING THEIR CHILDREN AND/OR WARDS TO ACCESS THE PLATFORM'S CONTENT.
